These Terms of Service ("Terms") are a binding agreement between you and ScrubMyX, a service of Socialhose ("ScrubMyX," "we," "us," or "our"), governing your access to and use of the ScrubMyX website, applications, and services (collectively, the "Service"). By creating an account, signing in with X, adding credit, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You must use the Service only with an X account that you own or are otherwise authorized to control, and you represent that you have all rights and authority necessary to instruct us to access and delete content on that account.
2. What ScrubMyX Does
ScrubMyX helps you review and delete your own content on X (formerly Twitter), including posts, replies, reposts, and likes. You can bring your own data by uploading an X data export (free), or have us collect your content directly through the official X API. Deletions are carried out by issuing calls to the official X API on your behalf.
Deletions are permanent and irreversible. Once content is removed on X, we cannot restore it, and neither can you. You are solely responsible for deciding what to delete. We recommend keeping your own copy of anything you may want later before you scrub it.
3. Credits, Billing, and No Refunds
ScrubMyX is prepaid and metered. You add credit to your wallet, and operations that consume the X API (scanning or collecting your content, and deleting it) draw down that balance at the per-request rate shown to you at the time. Payments are processed by our third-party payment processor (Stripe); we do not store your full card details.
All payments, deposits, and charges are final and non-refundable, to the fullest extent permitted by law. This includes, without limitation:
- Every scrub is charged and non-refundable regardless of outcome. Each deletion is a metered X API call. We charge for the attempt because the attempt consumes the call. This applies even if the targeted item was already deleted, never existed, has been made unavailable, is restricted or protected, or X returns an error, an empty result, or anything else. We act on your instruction, and the instruction is what is billed.
- Stale or duplicate data still counts. An X data export reflects a single point in time. If your uploaded export (or a prior scan) lists content that has since been removed on X, instructing us to scrub it still consumes a metered call and is non-refundable. The same applies to re-running a scrub over items you have already deleted.
- Scans and collection are non-refundable whether or not they find the content you expected, and regardless of how much content X returns.
- Unused wallet balances, change of mind, dissatisfaction with results, and account closure or termination do not entitle you to a refund.
You authorize us to charge your wallet for each operation you initiate. If you initiate a chargeback or payment dispute, we may suspend or terminate your access. We may change pricing at any time; changes apply to operations performed after the change takes effect.
4. How We Obtain Your Data, and Accuracy
ScrubMyX obtains your X data in two ways: through the official X API, and through your own upload of your X data export. When we collect through the API, the content, counts, and results you see reflect what X returns to us directly. What we get is what X says. When you upload your X data export, we act on the file as X generated it. In both cases we do not independently verify, supplement, or reconstruct the data. We do not control X and are not responsible for X's availability, rate limits, data accuracy, completeness, latency, policy changes, or any action X takes on your account. We do not guarantee that any particular item can be found, collected, or deleted, or that an operation will produce any particular result.
5. Acceptable Use
You agree not to:
- use the Service with any account you are not authorized to control;
- violate X's terms, the X Developer Agreement and Policy, or any applicable law in connection with your use of the Service;
- attempt to access, interfere with, reverse engineer, overload, or disrupt the Service or its infrastructure, or circumvent metering, billing, or access controls;
- use the Service to infringe others' rights or to harass, defraud, or harm anyone.
6. Your Content and Authorization
You retain ownership of your content. You grant us the rights needed to operate the Service, including to access, store, process, and act on your X data and any files you upload in order to provide, secure, and improve the Service, as described in our Privacy Policy. You are responsible for the content you instruct us to act on and for ensuring you have the right to do so.
7. Service Availability and Changes
We may modify, suspend, or discontinue the Service or any feature at any time. We may impose or change limits, and we may perform maintenance that interrupts availability. We are not liable for any modification, suspension, or discontinuation of the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DELETIONS WILL SUCCEED, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER SCRUBMYX NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, PROFITS, GOODWILL, OR THE DELETION OR LOSS OF YOUR X CONTENT, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Indemnification
You will indemnify and hold harmless ScrubMyX and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your instructions to delete content, or your violation of these Terms or any law or third-party right.
11. Termination
We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. On termination, your right to use the Service ends. Sections that by their nature should survive, including billing, disclaimers, limitation of liability, indemnification, and dispute resolution, survive termination. Termination does not entitle you to a refund of any prepaid balance.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute not subject to arbitration will be the state or federal courts located in Texas, and you consent to personal jurisdiction there. You and ScrubMyX waive any right to a jury trial and agree that any dispute will be resolved on an individual basis; class actions and class-wide arbitration are not permitted, to the extent allowed by law.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
